INTERIM LIEN LAW PROCEDURES
Regulations have not yet been promulgated for PL 2005, c.55.
In the interim persons affected by liens may contact the Supervisor
of Patients Accounts (SPA)at the State Psychiatric Hospital
where their hospitalization occurred and request an application
to have their lien(s) discharged. If they have liens from
more than one psychiatric hospital, a separate request must
be made to each hospital. "Discharges" of the Liens
will be filed at the appropriate State Superior Court or County
Clerk or Register of Deeds & Mortgages offices, immediately
upon the SPA's receipt of the completed "Request to Discharge
Lien" forms and the appropriate attachments.
Although this procedure will lead to their lien being removed,
the Department of Human Services is interpreting the law to
mean that the former patient's debt still remains. In order
to remove or reduce this debt it is necessary to request a
"compromise" through the SPA. When going through
the compromise process keep in mind that for all new patients
their obligation will be based on their ability to pay using
a sliding fee scale similar to the charity care scale. For
an individual whose income is below 200 percent of the Federal
Poverty Level or $19,140 there should be no charge for a state
or county hospitalization using this scale.
The new law also adds several factors that the Department
of Human Services must consider during the compromise process.
The commissioner shall allow the person or parent to retain
adequate funds to:
(a) maintain the person's or parent's housing and usual
standard of living in the community;
(b) provide for any necessary medical expenses or special
needs;
(c) support any minor, disabled, elderly or other dependent;
(d) establish a trust to ensure future self-sufficiency;
or
(e) provide for any other genuine financial needs.
The law further states, "Requests to compromise for
settlement of the obligation shall be liberally granted by
the commissioner and shall promote the person's or his parent's
opportunity to obtain and maintain employment, purchase property,
both real and personal, and achieve full reintegration into
the community, as applicable. The commissioner shall ensure
that all persons and parents are notified of their right to
request a compromise and the procedure for doing so."
